Abstract

Artificial Intelligence is becoming increasingly incorporated into different aspects of society, including our legal system. AI has potential to enter into legal proceedings through the introduction of its evidence in case and expert witness testimony. Expert witnesses are called to offer knowledge on matters relevant to a case and can vary in specialization. This study aimed to explore how attorneys view experts who use AI and how they would approach this in a courtroom setting. Structured interviews were conducted with ten attorneys from various jurisdictions. During these interviews, attorneys were asked what they have encountered during their work in the legal field in relation to AI. They were then asked to describe their approach to a hypothetical expert witness who had utilized an AI system during their work. Using thematic analysis, major themes were identified and explored. These themes included System Specifics, Expert Training, Explainability, Potential Bias, and Disqualification. Results showed that attorneys are not immediately accepting of methodologies that utilize AI and hold a general sentiment of skepticism. The results highlighted the importance of the need for future research given the rapid expansion of AI.
